Sec. 2-49. Public participation at board meetings.
(a) All persons desiring to address the board of county commissioners
shall limit their comments to the subject matter under discussion. Public
comment shall be directed to the chairperson presiding over the meeting and
not the audience or individual commissioners. Prior to addressing the board
each person shall fill out a speaker's form provided at the door stating the
speaker's name and address. All comments must be made from the podium after
stating your name first.
(b) There is a time limit for all persons speaking during public
hearings and workshops of the board of county commissioners and shall be
limited to the time period set aside for public comment. Individuals shall
be allotted three minutes and a person representing an organization shall be
allotted five minutes. Only one individual per organization shall be
allowed. Public comment shall be divided between those in favor and those
opposed to the subject matter under discussion with those individuals
speaking in favor speaking first. Rebuttal and surrebuttal shall not be
allowed.
(c) Members of the public wishing to speak at the beginning of a board
of county commissioners meeting on any subject under the jurisdiction of the
board shall be allotted three minutes to make their presentation or present
their request. If the subject matter requires investigation by county staff,
the chairperson shall refer the matter to the county administrator who shall
obtain a response to the individual making the request.
(d) When a main motion has been discussed by members of the board, the
chairperson shall recognize any member of the public present who wishes to
address the subject matter of the main motion. Public comment shall be
limited to the time limits set forth in subsection (b). This subsection
shall not apply to main motions made at the conclusion of a public hearing
or workshop where members of the public have already had an opportunity to
speak.
(e) Individuals who violate the rules of public participation shall be
requested to leave the podium and return to their seat. The use of
insulting, vulgar or profane language directed at the board, any member
thereof, or at members of the audience shall not be tolerated; any such
conduct may result in law enforcement officers being summoned to remove such
individuals from the meeting.
(f) The foregoing procedures shall apply to all quasi-legislative and
quasi-judicial matters unless formal quasi-judicial proceedings are
instituted as set forth in article II, division 3.
